1. Services
WebDataScraping.us provides custom web data scraping, data extraction, dataset delivery, and related data intelligence services for clients across ecommerce, AI training, healthcare, financial, real estate, travel, and other US-focused verticals. Specific deliverables, scope, pricing, and timelines are defined in individual Statements of Work (SOWs), service orders, or written agreements between WebDataScraping.us and the client.
2. Client Responsibilities
By engaging our services, the client represents and warrants that:
- The data they request is for lawful purposes
- They have the authority to use, store, and process the data delivered
- Their downstream use of the data complies with applicable laws including but not limited to data protection laws (CCPA, GDPR), terms of service of source websites where relevant, and industry-specific regulations (HIPAA, GLBA, FCRA)
- They will not use delivered data to harass, stalk, defraud, or otherwise harm any individual or entity
3. Data Collection Practices
WebDataScraping.us collects and delivers data through publicly accessible web sources. We:
- Do not bypass authentication, login walls, or technical access controls
- Respect
robots.txtdirectives as a signal in our collection practices - Do not collect or deliver protected health information (PHI) for any client
- Use reasonable rate-limiting to avoid undue load on source websites
- Use compliance-focused collection methods including provenance metadata where applicable
Clients acknowledge that web data sources, anti-bot measures, and applicable laws may change. We do not guarantee perpetual access to any specific source. Where a source becomes inaccessible or non-viable, we will notify the client and propose alternatives where possible.
4. Pricing and Payment
Pricing for our services is defined in the SOW or service order. Standard payment terms are Net 30 from invoice date unless otherwise agreed. Late payments may be subject to late fees and service suspension. All fees are exclusive of applicable taxes, which are the client's responsibility.
5. Service Level Agreement (SLA)
For ongoing managed pipelines (Growth and Enterprise tiers), we provide SLAs covering uptime, data freshness, and support response times. SLA-specific commitments and remedies are defined in the engagement-specific SOW. Pilot datasets and one-time deliveries are not subject to SLA terms.
6. Confidentiality and Data Protection
WebDataScraping.us treats all client information, including client SKU lists, target sources, and delivered datasets, as confidential. We offer NDA execution on request. We do not share client data with third parties outside of subcontractors and infrastructure providers necessary to deliver services, who are bound by appropriate confidentiality terms.
7. Intellectual Property
WebDataScraping.us retains all rights to our infrastructure, code, methodologies, and proprietary processes. Datasets delivered to clients are licensed for the client's internal business use as specified in the SOW. Resale or redistribution of delivered datasets requires separate written agreement.
8. Disclaimers
Services are provided "as is" and "as available". While we use commercially reasonable efforts to deliver accurate and timely data, we do not warrant that data will be complete, error-free, or uninterrupted. Source websites may change, restrict access, or remove data without notice.
WebDataScraping.us is not liable for client decisions made based on delivered data. Data accuracy validation remains the client's responsibility.
9. Limitation of Liability
To the maximum extent permitted by law, WebDataScraping.us's total liability for any claim arising out of or relating to these Terms or our services shall not exceed the fees paid by the client to WebDataScraping.us in the 12 months preceding the claim. WebDataScraping.us is not liable for any indirect, incidental, consequential, or punitive damages.
10. Indemnification
The client agrees to indemnify and hold harmless WebDataScraping.us from any claims, damages, or expenses arising from the client's use of delivered data, the client's breach of these Terms, or the client's violation of applicable law in connection with our services.
11. Termination
Either party may terminate an ongoing engagement with 30 days written notice unless otherwise specified in the SOW. WebDataScraping.us reserves the right to suspend or terminate services immediately for non-payment, breach of these Terms, or for legal or regulatory reasons.
12. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be resolved in the state or federal courts located in California.
13. Modifications
We may update these Terms periodically. Material changes will be communicated by updating the "Last updated" date and, for active clients, by written notice. Continued use of services after changes constitutes acceptance.
